What Is The Jones Act

The Jones Act which is actually the Merchant Marine Act of 1920 is a federal statute that requires shipping to U.S. ports to be done by ships that were constructed in the United States, carry an American crew and bear U.S. flags . In addition, the law provides protection for the crew members and the environment.

What this means is that foreign-flagged ships and today virtually all cruise ships are foreign-flagged and registered in other countries cant cruise between two ports that are located within the contiguous United States as well as some noncontiguous U.S. ports.

The Jones Act was not designed to cover passenger vessels.

The Jones Act was originally enacted as a safety measure as part of an increase to national security after World War I, when the U.S. fleet was destroyed by Germany. As its name indicates, Holland America is a cruise line that was established in 1873 to primarily ferry passengers, many of whom were emigrants, between the Netherlands and the United States. Of course, these days, the cruise line sails more broadly to more than 470 ports around the world on its 11 shipsand its highly regarded for its Alaska itineraries. Small Ship Line #1: Crystal Yacht Cruises

In early 2015, Crystal brought a yacht into its fleet for the first time, and following its success, the cruise line decided to custom-build a polar-class expedition megayacht. The ultra-luxe Crystal Endeavor, which sails to remote locations like the Arctic and the Antarctic, as well as urban ports around the world, launched in 2021, and can carry up to 200 passengers.

Initial Public Offering And Reorganisation

Following an initial public offering and corporate reorganisation in 2013, Norwegian was made a wholly owned subsidiary of Norwegian Cruise Line Holdings , while Norwegian’s previous owners Genting Hong Kong, Apollo Management and TPG Capital exchanged their stakes in Norwegian for shares in the newly listed NCLH.

On 11 March 2014, Norwegian announced that it was cancelling all future port calls in Tunisia following an incident wherein the country forbade Israeli nationals from disembarking.

In December 2016, Norwegian Cruise Line announced it had reached an agreement with the Cuban government. In May 2017, the Norwegian Sky was the first Norwegian Cruise Line vessel to ever visit Cuba. The Norwegian Sky makes weekly trips from Miami to Havana, making Norwegian the only line sailing that route weekly.

On May 2, 2017, Norwegian Cruise Line announced a new PortMiami Terminal. The construction began on May 1, 2018, and is scheduled for completion by fall 2019. Between 2022 and 2025, Fincantieri intends to deliver four ships and in July 2018, the company announced an order for two more Project Leonardo ships. They are expected to enter service in 2026 and 2027. In December 2018, Norwegian revealed plans to build a new pier in Alaska’s Icy Strait Point.

Mega Ship Line #: Norwegian Cruise Line

Known for its colorful ships, Norwegian Cruise Line first broke into the mega-ship category in 2010 with the launch of Norwegian Epic, which can carry just over 5,000 passengers at full occupancy, and the company has since introduced five others in the Breakaway and Breakaway-Plus classes. “Flag State” is the ship’s registration country under whose laws it is registered/licensed. Just like any marine vessel, a passenger ship operates under its flag state laws . Flag states have the authority and responsibility for a ship, exercising control over the ships. They inspect the ships regularly, certify equipment and crew, issue safety and pollution-related documents, etc.

Each of the flag states has its own ship register where all ships sailing under its flag need to be registered. Some countries even have more than one ship register.

Our Ruling: Partly False

Yes, cruise companies register their ships in foreign countries to avoid paying U.S. corporate taxes. But they did not receive a direct government bailout as part of the pandemic corporate assistance money approved by Congress. They did not publicly ask for a bailout. And it is not even clear that they privately asked for one. Based on our research, we rate this claim as PARTLY FALSE.

Where Is Norwegian Cruise Line Based And Where Are Ncl Cruise Ships Registered

Norwegian Cruise Line, which falls under the Norwegian Cruise Line Holdings umbrella, has a home base in Miami. Its ships are largely Bahamas-flagged, with others registered in Panama. Its Pride of America ship, which sails solely around the Hawaiian islands, is the only mainstream cruise vessel to be registered in the United States.

Inability To Respond To Crimes

There is no police department at sea, and the responsibility to investigate crimes falls on authorities in the country where the cruise ship is registered, according to the United Nations Convention on the Law of the Seas . The police in Malta, for instance, would be in charge of any investigation involving the Thomson Celebration.

After a crime, crewmembers â not authorities with legal jurisdiction â collect evidence and carry out an initial investigation.

English Captain Michael Lloyd, formerly the vice president of the International Cruise Victims Association, warned in 2014 that one of the industryâs key problems was a lack of capacity in many countries to investigate crimes aboard their flagged ships. The crewsâ lack of knowledge about legal requirements can also wind up obstructing and even invalidating investigations of crimes, he added.

Some countries âhave signed on to UNCLOS while they register ships, knowing full well that they are incapable of meeting the requirements,â Lloyd wrote.

Each year, hundreds of people are victims of crimes on cruise ships that dock in U.S. ports. U.S. regulations require the cruise companies to record the crimes and make the files available to the public and the Federal Bureau of Investigations according to nine categories, among them murders, suspicious death and sexual assaults.

What Is The Difference Between Closed And Open Registries

“Open Registries” are organizations that will register foreign-owned ships. One of the first open registries is the Liberian and Panamanian registries, followed by the Bahamian and Bermudian, and more recently – those of Malta and Portugal.

“Closed Registries” require that a cruise ship be owned and constructed by national interests and to be fully or partially crewed by its citizens. This usually increases the ship’s construction and operating costs. Italy and The Netherlands are two of the national registries featuring big-size cruise liners owned by companies like HAL-Holland America, Costa, AIDA.
